Child support and visitation rights of ex-wife

Question:

Asalamu Aleikum Ok, question is the following my husband recently divorced his first wive and he was paying child support for his two kids, but then he took one of his kids to the doctor and they told him that his son did not have insurance, so he said that he lived with us and they stoped the child support for one of the kids, so his ex wive told him that she did not want their son in her house and she took the kid to my husbands mom's house, is she wrong for doing that to her kid just because she was not getting money? Also now she wants my husband to take him to her on the weekends, is she doing right? dosen't she have to do what eer it takes for her to she her son insted of just sitting there demanding for my husband to take him?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

The father is obliged to spend on his children who are young and who do not have money to spend on themselves, and the mother or other relatives are not obliged to spend on the children so long as their father is able to spend on them.

Therefore, it is the right of this woman to refuse to foster her son whose father refused to spend on him and it is her right as well to give him to his grandmother.

As regards seeing the son, it is not due on his father to take him to the house of his mother so that she would see him; rather, the father must neither prevent the mother from seeing her son nor prevent the child from seeing his mother. For more benefit, please refer to Fatwa 84575.
