What you have mentioned about the company clearly stating that the client will receive a certain percentage from the value of the purchases "in the form of refunds to his bank account" as well as receiving a specified number of points on the amount paid as investment "units as in share", this does not eliminate the risk involved; rather, one pays money in return for a potential and unknown matter. One may receive high profits if he buys too much, and if one does not buy, he loses the subscription fees and all monies paid.
So what you have mentioned does not affect our answer in Fatwa 137046.
Also, the issue of whether a new member may earn more money than another member who participated five years ago based on activeness and diligence, then a network marketing system which is forbidden in Islam does not become permissible because of this. This is concerning whether the partner provides funds or buys commodities which he generally has no purpose for in return for profits and gains expected from marketing and from attracting new members.
