السلام عل??م ورحمت الله وبر?اتI'm Ahmad Bashir from Afghanistan. I am learning Amazon FBA course and after that I want to become a virtual assistant as FBA seller, so if I deal with a investor on, I will manage the selling and do the business, and they provide the asset for business and seller account. And any profit from selling will divided between us with specific percentage like 60 - 40% to each member. Is the income shariha legal or halal for us? Is this like a modaraba contract?Thanks,

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad, sallallaahu`alayhi wa sallam, is His slave and messenger.

Your work is not Mudaarabah (speculation), rather it is marketing, promotion, communication with customers, and so on. The basic ruling on marketing is that it is permissible, provided that the products that are marketed are permissible, and it is permissible for the marketing to be with a lump sum that the marketer takes, or with a known percentage of a known price that the marketer takes when he sells the product, such as if the owner of a product or the seller tells the marketer, “Sell this product for such-and-such price, and you will have such-and-such an amount or such-and-such percentage,” or “sell it for such-and-such price and the extra amount is yours.” All of this is permissible.
