Matters related to divorce

Question:

Assalamu Alaikum. My husband gave me a divorce on July 8. Then I had my period on July 24. Again, on August 8, he gave me divorce — three at once. Then I had my period on August 26. After I became clean, he again gave me divorce on September 2. Now, according to the Ahl-e-Hadith view, how many divorces have actually taken place? I know that according to the Hanafi view the divorce has already taken effect. Please give me the answer to my question

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad (sallallaahu 'alayhi wa sallam) is His slave and Messenger.

We advise that the husband communicates directly with a scholar, as there are matters that require clarification. However, generally and for benefit, we can mention the following:

First: If a husband divorces his wife during her menstrual period, or in a state of purity in which he had intercourse with her, then this is an innovated and forbidden divorce. The jurists differed regarding whether such a divorce takes effect. The majority of scholars hold that it does take effect, while Ibn Taymiyyah and his student Ibn Al-Qayyim ( may  Allaah  have  mercy  upon  them) held that it does not.

Second: If he divorces her three times at once, or three times separately without reconciling (raj‘ah), or a new contract occurring in between, then there is also a difference of opinion among scholars regarding its ruling. The majority of the scholars say that it counts as three divorces. Whereas a few of the scholars consider it to be as only one divorce, and this view was also chosen by Ibn Taymiyyah and Ibn Al-Qayyim ( may  Allaah  have  mercy  upon  them).

Lastly, we advise caution regarding marital problems. If problems arise, wisdom should be sought in resolving them, using any lawful means to address the issues, and divorce should not be resorted to unless it is deemed to be the better option.
