Inheritance of Two Daughters from Deceased Mother

Question:

What is the share of two daughters from their dead mother?

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

The two daughters of a deceased person take two-thirds from the entire inheritance provided there is no male child of the dead person.

Allah Says (what means): {Allah instructs you concerning your children: for the male, what is equal to the share of two females. But if there are [only] daughters, two or more, for them is two thirds of one's estate.} [Quran 4: 11]

The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said concerning the inheritance of the two daughters of Sa'd ibn Ar-Rabee'ah: “Give the two daughters of Sa'd two-thirds of the inheritance.” [Al-Haakim who graded it as Saheeh; Imam Ath-thahabi agreed with this ruling]

Another narration reads as follows: “Give the two daughters of Sa'd two-thirds of his whole wealth.” [At-Tirmithi and Ibn Maajah; Shaykh Al-Albaani graded it as Hasan]

It is better to consult an Islamic court to limit the legal inheritors, to settle the debts, and to implement the will before distributing the inheritance.
