Question:

I would like please if you could tell me how the inheritance will be divided in my case. I am married, my husband and I have no children together. I have 4 sisters no brothers. How will my money be divided in this case, if I die before my husband?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

If a woman dies and leaves a husband and four sisters, then the inheritance should be divided as follows:

The husband gets half of the share. The sisters get two-thirds, if all of them are sisters from the same mother and father, or all of them are from the father's side only (i.e. from a second wife). But if there are two sisters from the same father and mother or more, then they get two-thirds and the sisters from the father's side will not get any share. If there is only one sister from the father's and mother's side, then she gets half of the share and the sisters from the father's side will get a sixth part of the share in order to complete the two-thirds.

In any case, the above situation falls under the laws of 'Awl which means that the shares of inheritors exceed the sum of the total inheritance. By applying the laws of 'Awl, the shares are regulated.

In the above case, the inheritance is distributed into seven shares: the husband gets three  shares, and the sisters get four shares.

Allaah Knows best.
