Wants to marry while studying

Question:

I have a fiancée and her parents like me and agree with our relationship, the problem is, they won't and never give us permission to get marry when we are studying but now, I fear that I couldn't control myself and commit Zina (I really afraid) and I feel that it is Waajib for me to get marry.. So, what should I do now? Should I get marry using Wali Hakim and not telling her parents? I just want to have legal relationship but at the same time I don't want our parents hate us (by getting marry while studying). Please help me.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

 

We ask Allaah to help you and make your problems easy.

We advise the fiancé and fiancée to try the best to convince your parents to marry you. Let them believe that marriage does not disturb study, rather it helps spouses concentrate and have peace of mind.

However, a male does not need a guardian for his marriage but the marriage of a girl is not valid without the consent of her guardian. Details are mentioned in our previous Fatwas: 85026 and 82103.

If the guardian refuses to marry her without any Islamic reason, she may ask the help of a Muslim ruler or whoever represents him, such as a Muslim Judge, or the Muslim community in that area as we have mentioned in our Fatwa: 83394.
