All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
First of all, it should be mentioned that it is forbidden for a woman to ask for divorce without a sound religious reason. It is confirmed that the Prophet said: "Any woman who asks her husband to divorce her, without a religiously accepted reason, the smell of
If we assume that the wife hates her husband and she fears that this will lead her to be neglectful about his rights, then she has the right to ask for divorce by paying a compensation to her husband; this is called Khul', and this is what the wife of Thaabit Ibn Qays did.
As regards renouncing the fostering of the child, the mother has the right to do so if it is not an obligation on her to foster her child, unless there are no other female relatives to foster him/her. So, in case it is an obligation on her to foster the child, it is not permissible for her to refuse, or else she will be sinful. However, if there are other female relatives of the child who are eligible for his/her fostering, then she is not obliged to foster him/her, and she is then permitted to refuse the fostering. The fostering is a right for the person who is eligible for fostering and not an obligation. Nonetheless, this does not mean that she is permitted to cut the ties of kinship with her child. It is permitted to renounce the fostering but it is not permitted to cut the relations with kinship.
Finally, it should be noted that the spouses should avoid disputes and be keen to spread the spirit of affection and love especially if they have children. Indeed there is a danger on the children and their nurturing when the husband and wife separate or divorce.
