Someone who has not performed farewell Tawaaf and is unable to offer Hady

Question

You have previously given me a Fatwa indicating that a sheep is due on me to be slaughtered and distributed on the poor inhabitants of Makkah because my farewell Tawaaf (circumambulation) was invalid. Now, however, I am unable to do it because I have returned to my country outside Saudi Arabia. Is there any other possible expiation?

Answer

All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

If you can deputize somebody to slaughter the hady (sacrificial animal) and distribute its flesh on your behalf among the poor inhabitants of Makkah, then it is due on you to do so. If you cannot do so and are unable to slaughter a hady, then you must fast ten days, analogous to the case of someone who is unable to offer the sacrifice of Tamattu‘. In his Al-Mughni, Ibn Qudaamah says:

"Analogous to it, i.e. the sacrifice of Tamattu‘, is each kind of sacrifice that is due for leaving an obligation, like that of Qiran, assuming Ihram (ritual state of consecration) from outside the Meeqat (place at which one must assume Ihram), failing to stand at ‘Arafah till sunset, failing to spend the night in Muzdalifah, failing to throw the pebbles, failing to spend the night at Mina, and failing to perform the farewell Tawaaf. In each of these cases, it is due to offer what is available of hady. If one cannot find (or afford) it, then it is due upon him to fast ten days."
