Dividing one's property amongst his heirs before performing Hajj Fatwa No: 92187
- Fatwa Date:11-7-2006
Insha allah ,my father is proposed to perform Haj.He is not having financial liabilities.but he is having some assets in the form of land. Some persons advised him to share this property among his children and do the Hajj.We the childrens , not demand for sharing the property.what is the sharia ruling regarding this issue provided my father is not having liabilities.
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
A person who wants to go for Hajj or ‘Umrah is not obliged to divide his land or any other property amongst his heirs; this is not an obligation or even something desirable. If it happens that he dies while performing the above rituals, the Islamic Law has thoroughly clarified the share of each heir.
