Fatwa No: 100037

Question

I have a daughter who lives with her husband in their own house. They are somewhat poor. Can I give them zakah?

Answer

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

If you are asking about zakah Al-Fitr, then you are not required to pay it on your daughter’s behalf. This is because it is her husband’s duty to do this if he has food supplies that exceed his needs on the eve and the day of Eid Al-Fitr. In this case, he is to pay the zakah for himself and for his family if he is able to do so; otherwise, he pays what he can afford. This goes in line with the verse that says (what means): {So fear Allah as much as you are able…} [Quran 64: 16]

If you are asking about zakah on wealth, then this type of zakah is obligatory only on whoever owns the nisab (the minimum amount of wealth liable for zakah) This amount is estimated at 85 grams of gold. Also, one has to own the nisab for one lunar year.

It is worth nothing that if your daughter’s husband is poor, you may pay Zakah Al-Fitr as well as the zakah on your wealth to him.

Allah knows best.
