Aslamu Alikum, Happy Ramadan, My husband and I married for one year, we based our marriage on him to instill Islam in to our daily lives, we are very much in love with each other, we live in seperate countries hoping to rejoin. I waited for his release from serivices to have him join me in my country. While I make necessary plans to have him join me, he is advised by the services to end relation with me, as his mother is being enterogated of me. We did not want a divorce, now we agree for a divorce to keep my mother in law safe, and my husband safe. Insha allah I love him very much and he loves me very much! can I ask him to marry me back? when can I do ? and how to do? I prefer not to marry another to get divorce to re-marry the muslim man I love. I want to do the right thing, I am new Muslima and this is also why he choose me to marry. Salam
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
If divorce took place after your husband consummated the marriage with you, then it is a revocable divorce and it is permissible for him to take you back without a new marriage contract as long as you are still in your waiting period. If your waiting period is over, the divorce becomes irrevocable but he can take you back with a new marriage contract (if he did not divorce you three times) and the same thing applies if he divorced you before consummating the marriage with you. However, you are permitted to ask him to take you back if you are still in your waiting period and if your waiting period had expired, then you may ask him to conduct a new marriage contract with you. But, if his marriage to you may cause harm to him or to his mother, then you should not think to marry him and ask Allaah to predestine for you whatever is good.
Besides, you may seek the help of your pious Muslim sisters or trustworthy Islamic Centers in your country (to look for a pious husband for you). Indeed, a person who seeks advice never fails and a person who performs Istikhaarah prayer never regrets. For more details, refer to Fatwa 81434. In addition to this, a Muslim is weak if he is alone, but he/she is strong with the help of his/her fellow Muslims.
