Her brother borrowed her money and does not talk about it Fatwa No: 135331

assalam u alaikum i am married to my cousin, masha allah for 24 years. as he knows my family problem andi know his. there is nothing to hide. my brother is a docter when he got married he was not working he took 2lakhs from us to go to honeymoon in 2003/ in 2005 he told he will give me back in 3 years another time he took 50 thousand in 2008 my problem is that he is not telling nor giving money, he is keeping quiet .he is doing a job but he does not say about his salary. now you tell me what should i do ? should i ask give me the solution by allah's grace we are well settled. i want my money back from him
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
It is permissible for you to ask your brother to give you back your loan since he is not in financial difficulties. Contrarily, he should take the initiative to give you back your debts himself without urging you to ask for it because the procrastination of a rich person is an injustice as per a Saheeh Hadeeth. Procrastination is delaying what is due without any sound reason.
However, we have already clarified in Fatwa 128088 that it is permissible for a creditor to ask his debtor to pay back his debts if he is well-off and this does not decrease his (the creditor’s) reward.
