She is heartbroken because her husband decided to leave her
Fatwa No: 135701

Question

My Arabic husband of three years (marriage by Sharif), was going through some legal issues in the US and could return home. He is very stressed, walked out on me saying he wanted no responsibilities and wanted to enjoy his life without me. I supported him financially. He came into some money and changed. I am heart-broken. I have no Muslim/Islamic family/friends to confide in.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.

You did not mention to us whether or not your husband had divorced you, because if he did not divorce you, you are still his wife. Separation by itself is not considered a divorce as we clarified in Fatwa 82732. Therefore, we advise you first of all to supplicate Allaah to reconcile between you and him. If we presume that he had issued divorce, then you can try to convince him to take you back without a new contract if you are still in your waiting period. If your waiting period had expired, then a new marriage contract must be conducted. For more benefit on the kinds of divorce, please refer to Fatwa 82541.

It is permissible for you to seek the help of some righteous people like those who run trustworthy Islamic Centers. Then if reconciliation takes place, then that is what is required, but if he insists on separation and he does not want to reconcile, then you should seek the help of Allaah to bless you with another husband. Allaah Says (what means): {But if they separate [by divorce], Allaah will enrich each [of them] from His abundance. And ever is Allaah Encompassing and Wise.}[Quran 4:130]

Finally, it should be noted that it is not permissible for you to marry another man unless you make sure that your husband had divorced you and your waiting period from him had expired.

Allaah Knows best.
