Doubts about divorce Fatwa No: 174821

Assalmualiakum following your response "Reply: Dear brother... kindly be more precise and expalin what you mean by shhhh sound and what is the relation to devorce???" well basically i keep thinking that i whispered a dvorce statement when i was talking to myself. so than i keep repeating repeating dvorce statement to myself too see if i did whisper this. but when i say it in my mind and whisper it to myself im not moving my tongue much and all that comes out of my mouth is a hss sound or a shhh sound and there is a frequency in the hssing noise when im saying it, but im only saying it to try and remember if i said a dvorce statement. i asked my wife to tell me if what i am hissing sounds like a dvorce statement but she said this is all in my mind and i shouldnt worry about it. I dont know if this is called waswas, because i really DONT want a dvorce. but i know what im saying in my mind and if while im saying it in my mind and a hissing or shh noise comes out does it constitute dvorce

Having mere whispers about divorce does not lead to divorce; for more benefit, please refer to Fatwa 118574.
Besides, divorce by just moving the tongue without the person himself being able to hear his voice does not lead to divorce according to the view of the majority of the jurists .
As regards when a person doubts in principle whether or not he uttered the word divorce, then in principle, he did not, and so, his divorce does not take place. Thus, the certainty of the continuation (the validity) of the bond of marriage is not terminated by doubt about divorce.

On the other hand, it appears that you are suffering from whispers and the divorce of a person who suffers from whispers does not take place even if he utters the word divorce in a way he could hear it himself, as he is considered an insane person who is driven to divorce unwillingly. Finally, it should be noted that the best way of treating whispers is to repel them and seek refuge in Allaah The Almighty from Satan and remember Allaah The Almighty as much as possible. For more benefit, please refer to Fatwa 90425.
