Her husband deceived store by buying a new faucet and returning an old one Fatwa No: 248047

Salam ,my husband buyed a faucet for the kitchen and returned the old one in the box and returned it with the receipt and homedepot gave him his money back .i told him it's haram and return it or buy another faucet and return the box without any one knowing and without getting money back he did not listen so I said I'm going to get a job and pay the money or return the original faucet or buy one and return it on the shelf without anyone knowing .and let my husband be aware tht I'm doing it so sheikh do u think I'm doing the right thing one of the above to make sure I return what is not ours??and am a sin if I use that faucet or god knows and doubt they my husband done it more than once what should I do???
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.
It is permissible for you to use the faucet which your husband bought but deceived the seller by taking that which he did no have the right to take, by getting back the cost of the item that he had paid. Thus, the seller has a right to that cost and it is an obligation to give it back to him. If you give him back the cost of the item, then you have done what is required. It is not necessary to tell the seller about the deception your husband did; rather, you may return the cost of the item to him indirectly.
As regards having suspicion over whether your husband did that more than once, then this is of no consideration as long as he did not confess to it and it is not proven. However, he should be advised and it should be clarified to him that what he did is not permissible, and that it is an obligation to return the rights of people or ask their forgiveness in this worldly life before there would be no Dinaar nor Dirham to ransom oneself with but only good deeds and bad deeds.
May Allaah reward you for enjoining your husband to do good and forbidding him from doing evil and this is how a righteous wife should be.
