Ruling on Performing Copper-T Intrauterine Device Insertion in Patients Fatwa No: 461263

Assalaamualai kum sir, l am a gynaecologist in India where most of the population is non Muslim...i m posted in a hospital as a resident gynaecologist where my seniors ask me to perform Copper T insertion in patients which is a temporary method of contraception but it's mechanism of action is that it prevents implantation of an already formed zygote and thus seems to be prohibited in Islam. ..if I m performing copper T insertion on patients due to the pressure from my department of gynaecology, am I being sinful for that...although within my heart I consider it wrong according to Islam. ..i m also afraid of assisting procedures like sterilisation and termination of pregnancy....if I m only assisting my senior in these procedures (due to the liability on me from my department) and not actually performing these procedures as a primary surgeon , then am I committing a sin...although I hate even assisting these procedures. ..by heart, I feel that INSHALLAAH when I will be trained enough to run my private practice, I would not encourage these procedures among my own patients. ...Jazaak ALLAH khayran. ..

We have already clarified in Fatwa 82423 that Copper-T Intrauterine device (IUD) insertion is not permissible, because this usually leads to having a close look at the ‘Awrah (woman's private parts) unless there is a necessity while there is no other safe means.
Therefore, if the case in which the doctor decided to install the Copper-T is not a case that is permissible, then it is not permissible for you to install it.
The same thing applies to abortion, it is forbidden even if the fetus is in the Nutfah stage, according to the view that we consider to be the preponderant one among the statements of the scholars of Fiqh.
Nonetheless, some of them permitted abortion if the fetus has not yet reached forty days, and others permitted it when there is a sound excuse before the soul is breathed into the fetus.
Some of the scholars did not condition having a sound excuse; rather, they permitted it without any restrictions –meaning before the soul is breathed into the fetus. However, the sin is greater if the soul is breathed into the fetus as this is killing a soul, which Allah has forbidden except with a right cause. So abortion in this case is prohibited except for a necessity, such as the fear for the mother's life.
Therefore, it is not permissible to help in abortion with any kind of assistance, such as sterilization, unless it is a case when it is permissible to do so.
Hence, if you can abide by these conditions and the hospital accepts that you do not participate in cases when it is not permissible to carry out an abortion, then there is nothing wrong with continuing in working in this hospital. Otherwise, you must leave and look for another hospital. We hope that you will succeed in doing so.

Moreover, a Bedouin narrated that the Prophet took him by the hand and taught him the following: "You do not leave something for the Sake of Allah, except that Allah gives you something better than it." [Ahmad]
