Some Rulings Regarding ‘Iddah and Marriage Fatwa No: 463174
- Fatwa Date:14-9-2022
Im not sure if my iddah was finished when i remarried. My first husband divorced me 21 november. I bled 5th - 15th december (it was a midcarriage, lose of 5 week old baby). I then bled 20th dec -25 dec. Then after that i bled 10th jan - 14th. Then 7th feb - 11feb. I have bled for times in total. But im not sure if the second bleed was part of the miscarriage or if it is considered a period. I remarried 27th feb. Is my marriage valid or should we make a new marriage contract?
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
If the second bleeding that you experienced on the 20th of December occurred during the time of your regular period, it is considered menstrual bleeding, otherwise, it is considered Istihaadhah (vaginal bleeding outside the menstrual period) in continuation of the previous bleeding on the 15th of December. If it was menstrual bleeding, you would have experienced three menstrual bleedings before your marriage and accordingly, your marriage contract would be valid. If it was Istihaadah, your marriage is invalid and it is incumbent on you to refrain from engaging in intimacy with your husband until you renew the marriage contract.
Allah knows best.
