Praying behind Imam of a different Madhab Fatwa No: 85594
- Fatwa Date:17-2-2003
I want to ask this question which was in my mind for the last few months. I enquired about it with others but I have'nt got a satisfactory reply? My question is,(1) Salat-e-eid is performed with six extra takbeers by Hanafis, which is contradictory to the saheeh ahadeeth. Even though saheeh hadeeth are available in all matters they simply refuse them and say they are following Abu Hanifa (r.t)? My question is can we pray salat-e-eid with them though they are not praying as established by saheeh ahadeeth?(2)Some scholars are saying that it is not necessary to raise one's hands while saying takbeer in salat-e-eid and salat-e-Janaza, as the the hadeeh narrated by Abdullah bin Umar(r.a) is weak? is it true? Are there any saheeh ahadeeth in this matter?(3)I also want to know about books of Fiqh?
Praise be to Allah, the Lord of the Worlds; and may His blessings and peace be upon our Prophet Muhammad and upon all his Family and Companions.
The Muslim scholars clearly approved that performing prayers behind an Imam who follows another opinion or school of thought is permissible even if he practices what is forbidden according to the opinion of the follower. Imam Dardeer said in the explanation of the book of Imam Khaleel : it is permitted to follow a blind man and the one who follows a different opinion in the prayers such as a Maliki follows a Shafi or Hanafi even if the Imam commits what nullifies Wudu such as touching his private parts or wiping only a part of his head during his Wudu, etc.
Therefore, the enquirer person may follow the Hanfi Imam.
Dear brother, know that there is no clear Hadith that proves the fixed numbers of Takbeers in Eid prayers. The author of 'Awn al-M'abood' said: 'Imam Ahmad Ibn Hanbal said, there is no authentic Hadith proving the numbers of Takbeers in Eid prayers; Imam al-Hakim also has the same opinion.'
There are also different opinions as far as the matter of raising hands for Takbeerat in Eid prayers is concerned.
The reason for this disagreement is that there is no sound Hadith in this regard. There is a 'Athr (action or saying of a Sahabi) from Umar Ibn al-Khattab as reported from the author of 'Awn al-Mabood' who quoted it from the book of Imam al-Baihaqi 'al-M'arifah'.
The authentic books in the four schools of Fiqh are as follows:
In al-Hanafi school: al-Mabsoot and Bda'e al-Sanaie.
In al-Maliki school: Hshiya al-Adawi al al-Risalah and Hashiyah al-Dasooqi Ala al-Sharhal al-Kabeer.
In al-Shafi school: al-Majmooa and Mughni al-Muhtaj
In al-Hanbali school: Kashaf al-Qan'a and al-Mughni written by Ibn al-Qudamah .
Allah knows best.
