Consummating marriage without having witnesses in marriage contract Fatwa No: 92451
- Fatwa Date:18-9-2006
IF ONE CONSUMATES MARRIAGE BEFORE WITNESSING BUT, WHAT IS THE IMPLICATION OF THAT MARRIAGE? IF REALIZED AAND WITNESSING IS LATER DONE, IS IT OK?
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
We have already issued Fatwa 83629 clarifying the conditions of a correct marriage and that witnesses are one of these conditions.
Therefore, if there are no witnesses in this marriage contract, then the marriage is void.
We clarified the things which result from a void marriage in Fatwa 81777, so please refer to it.
Having two people as witnesses (attest to the marriage contract) after consummating the marriage does not render the marriage contract valid.
Allaah Knows best.
