Drinking the urine of cattle and sheep Fatwa No: 240034

Assalamu `Alaykum respected scholars I have one question and i kindly request you to shed light on in detail. may allah bless you all Q1) i believe according to one school of thought/Manhaj (Ahl al-Hadeeth/Salafiyyah) proven that all or every body part of the halaal animals (like cattle) is halaal and those who declare certain parts to be haraam for human consumption base it on qiyaas and not an authentic hadeeth. Using this some brothers claim that even the Urine of goats or cattle is halaal (for human consumption as well). Please resolve this query
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
First of all, we say that there is a difference of opinion among the scholars about the urine and dung of the animal whose meat is lawful to us: some of them said that it is pure and some of them said that it is impure. They are all Imaams who made Ijtihaad (i.e. the effort a jurist makes to deduce the verdict) and they are prominent scholars, and each group has its own evidence which they perceive to support their view.
The scholars who are of the view that it is pure provided many prooftexts, among which are the following:
1. The Hadeeth about the tribe of ‘Uranah who disliked staying in Madeenah and got sick, so the Prophet ordered them to go to his shepherd and drink from the urine and milk of his camels. The Hadeeth is reported by Al-Bukhari, Muslim, At-Tirmithi and others.
2. The Hadeeth about the permission of praying in the pens of sheep and goats, like the Hadeeth which reads: “Pray in the sheep pens.” Had its urine been impure, the prayer would not have been permissible in pens of sheep.
3. The Hadeeth of Al-Baraa’ as ascribed to the Prophet, sallallaahu 'alayhi wa sallam: "The urine of an animal whose meat we are allowed to eat is not impure.” Another Hadeeth from Jaabir reads: “The animal whose meat we are allowed to eat, its urine is not impure.” These two Ahadeeth are reported by Ad-Daaraqutni and they are Dha’eef (weak). Ibn Hajar said in At-Talkhees that the chain of narrators of each one of these two Ahaadeeth is very weak.
This is also the view of Imaam Maalik, Imaam Ahmad and their followers, and the same view was held by the Shaafi'i scholars Ibn Khuzaymah, Ibn Al-Munthir and Ibn Hibban, and it is the opinion chosen by a group of later Hadeeth researchers.
On the other hand, the scholars who are of the view that the urine of an animal whose meat we are allowed to eat is impure did not base their opinion on Qiyaas (analogy) as you mentioned but they, too, provided as evidence some Ahaadeeth, among which are the following:
1. A Hadeeth ascribed to the Prophet by way of Abu Hurayrah : “Purify yourselves from urine as most punishment of the grave is from it.” Ibn Khuzaymah and others classified it as Saheeh [sound]. They said that this Hadeeth is general and it includes all kinds of urine, so it must be avoided due to this warning.
2. A Hadeeth from Ibn ‘Abbaas that “the Prophet passed by two graves and he said: They are being punished (in their graves) and they are not being punished for a grave sin; the first one did not cleanse himself (properly) from urine….” [Al-Bukhari and Muslim] They said that the Prophet generalized urine and did not restrict it to the urine of the human being. This is the view of Imaam Ash-Shaafi’i and Abu Haneefah and their followers. They said that when the Prophet commanded the people of ‘Uranah to drink the urine of camels, it was for the sake of treatment and not because it is pure in principle; it was for a necessity.
The first view is the view we adopt here in Islamweb, and our answer to the evidence provided by the second group of scholars is that the urine that is mentioned in the two Ahaadeeth is the urine of the human being, as the wording of the Hadeeth in Saheeh Al-Bukhari is: “...the first one did not cleanse himself from his urine...” Al-Bukhari said: “He [the Prophet] only mentioned the urine of the human being.”
