Ruling on a blasphemer's wife Fatwa No: 25456

My husband is an edgy person and whenever something annoys him, even if is trivial, he blasphemes Allaah the Almighty and his religion, although he is a religious person who regularly performs prayer and calls others to goodness. He does not do this in front of people though, only at home, and I do not feel that his conscience blames him or that he repents to Allaah the Almighty afterwards. What is the Sharee'ah ruling in this regard?
All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.
Blaspheming Allaah the Almighty and His religion is an act of disbelief that expels a person from Islam.
The Hanbali scholar Ibn Qudaamah stated that whoever blasphemes Allaah the Almighty, whether in jest or seriously, is a disbeliever, and this is also applicable to a person who ridicules Allaah the Almighty, His verses or His messengers. Allaah the Almighty Says (what means): {And if you ask them, they will surely say, "We were only conversing and playing." Say, "Is it Allah and His verses and His Messenger that you were mocking?"Make no excuse; you have disbelieved after your belief.} [Quran 9:65-66]
Therefore, if you are certain that your husband blasphemes Allaah the Almighty and His religion without repentance, you are not allowed to remain with him or to allow him to enjoy you as a wife. Allaah the Almighty Says about disbelievers’ wives (what means): {Then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for them.} [Quran 60:10]
You must abandon this man by asking for a divorce or submit his case to a Muslim judge (or the Islamic center in your area) so a verdict can be issued.
