Rights that Are Bounding by the Contract Fatwa No: 461230
- Fatwa Date:31-7-2022
Alsalam AlaikumMe and my husband bought a show house (in which you buy the house and the builder company rent it from us and pay us on monthly bases so that they open the house to public without us living in it) we had a contract with them for 12 months now the contract is off and we moved in , but the problem they payed us 10 months only, now there is almost 10000 australian dollars they should pay us but they didnt .We thought maybe we should try send them friendly letter in which we ask for our money before going to court but considering that they are not muslims we dont know how to emphasise for them that this our right and what they have done is stealing plz advice us what we can say knowing that they are either atheists or christians Thank you
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
As long as the company rented the house and got its benefit during the period of the contract, then it must pay you the full fee and you have the right to ask the company for the remaining amount.
The fact that the company is owned by non-Muslims, then this does not prevent you from asking for your rights that are bounding by the contract between you and them.
As regards the suitable method for asking for your right, then you may seek the consultation of the specialists in the field, such as the jurists and others.
Allah knows best.
