Conditions of Repairing Scooter on One-Year Warranty
Fatwa No: 475300

Question

I bought a scooter that didn't work after some time it had a one-year warranty. My father was on the phone with the company for repair I think he lied for no-cost repair (I heard the battery didn't come under the one-year warranty which apparently was in need of repair) he said he was charging it regularly and it was like twenty days since the scooter was not working but I informed him months ago that it wasn't. I was hearing the conversation and when asked about the date he bought it he affirmed when I bought it. The scooter is now fixed. I am scared of wrong. Please advise.

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.

This warranty is permissible if it is included in the contract for the purchase of this scooter and similar devices. In this contract, the producer or seller must ensure that the sold item is free from manufacturing and technical defects and is committed to its suitability to function during the agreed period. Under this guarantee, the producer or the seller undertakes to repair the manufacturing and technical defect that occurred on the sold item or replace it with another if necessary. It should be noted that this warranty does not guarantee defects that arise from the buyer's misuse and lack of care for the sold item. Therefore, for some devices that need maintenance, in order to act upon the warranty, it is required for the buyer to comply with the proposed maintenance schedule.

Accordingly, if the conditions for repairing the scooter meets the agreed warranty, then you may repair it for free. However, if these conditions do not apply to you, then it is not permissible for you to deceive and conceal the negligence that was on your part in order to obtain this guarantee. In this case, you have to explain the truth to the company and pay the repair cost to it unless it pardons you and exempts you from the value of the cost.

Allah knows best.
