Non-Muslim Impregnated Non-Muslim Girlfriend and Wants to Marry
Fatwa No: 84274

Question

I am not a Muslim but I have recently been studying the Qur'an, reading pamphlets, talking with Muslim friends, going to mosque, etc. I would like to convert. My girlfriend and I (who have been planning on getting married for several months) committed Zina. She is now 1 month pregnant. We plan on getting married soon. She is not Muslim but will allow the child to be raised in Islam. How can I make this situation right in the eyes of Allah?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.

We ask Allah to lighten your heart with belief in Allah. We advise you to hasten to accept Islam as soon as possible without any delay. Allah will make your matters easy. Encourage your fiancée also to embrace Islam; indeed it will cause harmony and love between you both. If she embraces Islam you should marry her after giving birth since this pregnancy is not lawful as you mentioned in your question.

If she refuses Islam you should give up marrying her even if she is a Jewish or Christian since she is not chaste.

It is not permitted in the Sharee'ah to marry any non-Muslim woman except women from the People of Book with the condition of being chaste. Allah Says (what means): {This day [all] good foods have been made lawful, and the food of those who were given the Scripture is lawful for you and your food is lawful for them. And [lawful in marriage are] chaste women from among the believers and chaste women from among those who were given the Scripture before you, when you have given them their due compensation, desiring chastity, not unlawful sexual intercourse or taking [secret] lovers. And whoever denies the faith - his work has become worthless, and he, in the Hereafter, will be among the losers.} [Quran 5:5]

This permission is actually among the features of Islam that are rarely found in other religions.

We encourage our brother to hasten to embrace Islam; it is the true religion. Merely admitting to the truthfulness of this religion has no advantages.

Allah knows best.
