Living in a country apart from his wife and he cannot travel to see her Fatwa No: 88642
- Fatwa Date:14-9-2004
I ask you a question towards my family I am married and I live in Swisher Land and my wife is not with me she is my country in Somalia and I don't have document to go there so I give everything she needs, so what is in the Islaam says like me?
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
It is not permissible for a husband to be absent from his wife more than six months except if she allows him. Therefore, if your wife gives you permission to be absent from her for more than six months, then there is no harm on you, because this is one of her rights. However, if she did not give you permission, then you may give her the choice of staying with you or being divorced. You have to endeavour to find a way to be able to reside with your wife (and family) as in that manner you will protect your chastity and safeguard yourself and them.
Finally, we draw your attention that it is not permitted to reside in a non-Muslim country without a necessity. It is confirmed that the Prophet forbade that. In addition to this a Muslim is subjected to temptations (by women), tribulations and afflictions by staying there.
Allaah knows best.
