Fatwa No: 283681

Question

asalaam alaikum prayers that are miss intentionally without any valid reason can we make the prayer in makrooh times?[I know we can make prayer in makrooh times if we miss for a valid reason]

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

Whoever misses a prayer is obliged to make up for it even in a time of dislike (reprehensibility), according to the preferred opinion of scholars. This was also the opinion of the majority of the jurists. Ibn Qudaamah said: "He makes up for the missed obligatory prayers. It is permissible to make up for the missed obligatory prayers at all times, disliked and others. This opinion has been reported from ‘Ali and other Companions. It was also held by Abu Al-‘Aaliyah, An-Nakha‘i, Ash-Sha‘bi, Al-Hakam, Hammaad, Maalik, Al-Awzaa‘i, Ash-Shaafi‘i, Is-haaq, Abu Thawr and Ibn Al-Munthir." [Al-Mughni]

In this regard, there is no difference between making up for obligatory prayers missed for a valid reason and those deliberately missed for no valid reason. In fact, there is greater reason to immediately make up for a prayer that was missed for no valid reason than to make up for one missed for a valid reason, even according to the scholars who hold that the making up of a prayer missed for a valid reason may be delayed.

Mughni Al-Muhtaaj, a Shaafi'i book, reads: "Whoever misses a prayer for a reason, such as sleeping or forgetfulness, he is not obliged to make up for it immediately; but it is recommended to hasten to make up for it. As to the prayer missed for no reason, it is obligatory to make up for it immediately, without any delay, given the neglect on his part." [End of quote]

Asna Al-Mataalib, a Shaafi'i book, reads, "It is an obligation to make up for the missed obligatory prayers according to the Hadeeth of the Prophet, sallallaahu ‘alayhi wa sallam, that reads: 'Whoever sleeps and misses the prayer or forgets it, let him pray it when he remembers it.' [Al-Bukhari and Muslim] If it was missed for no reason, it is an obligation to make up for it immediately. If it was missed for a reason, then it is recommended to make up for it immediately." [End of quote]

In brief, the obligatory prayer should be made up for immediately even in a time of dislike, whether it was missed for a valid reason or for no reason.
