Muslims must abide by the contractual conditions they accept

Question

Assalam o alaikum dear scholars. My question is that I & my 2 other brothers are govt servants in different ranks. Govt offered plot schemes for different ranks. None of us are in a position to apply for scheme due to high installments. If one of us applies against scheme of his position but idea is to contribute all of us and at the end distribute the plot in 3 equal parts. Is this legal by islamic rules.jazakallah

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

The crucial factor here is the conditions stipulated by the land provider, which is the government in your case. If what you are going to do does not violate any of the stipulated conditions and is not a trick to circumvent them, then there is no harm in that. However, if it involves cheating, fraud or deception in any way, it is impermissible to partake in such an act except with the permission and consent of the provider (government). Allaah The Exalted says (what means): {O you who have believed, fulfill (all) contracts.} [Quran 5:1], and the Prophet, sallallaahu ‘alayhi wa sallam, said: "Muslims are bound by their conditions." [Abu Daawood]
