Salam Walikum,
My name is Faisal Muzaffar, i got married to this nice lady doctor .but 6 months aftere our marriage i came to know that she is suffering from a disease and cannot be a mother.
we still did not care aboyut it and my family treated her like queen.
But with my age the desire was getting styronger for child and i got married while i was working in singapore and i told my wife afterward , about 2 months later, but i already had her permission.
My wife got veryu angry and left the house and in few days she made the divorce papers on my behalf as i wanted to give her divorce, in reality i never allowed verbally or orally to make papers using my name .
SDecondly i waitted for her for 8 months to come back home and than i decided to visit my singaporean wife that was the point my wife could not take and demaned to divorce her.
the papers she had made on my behalf she had signed it immediately , in other words i did the signature after 8 months and secondly there was no intention on my side to divorce her, and there was no witness that can say that we saw him signed the papers.
HELP ME OUT, ARE WE STILL MARRIED OR DIVORCED.
SALAM WALIKUM

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

Just signing a paper on which divorce is written is not considered as divorce unless the husband intended to initiate divorce by signing the paper. Since you mentioned that you did not intend to initiate divorce, then divorce did not take place and your wife is still your wife and it is not permissible for her to ask you for divorce because of marrying a second wife. Her disobedience to you and going out of the house without your permission is a forbidden Nushooz (ill-conduct). Therefore, you should admonish her with wisdom and try to reconcile your disagreements. You should not resort to divorce unless the marital relationship between you and her becomes impossible. Divorce is like cauterization, it should only be a last medicine [after all other attempts have been tried].
