Pharmacy Dispensing Medication and Paying 10% of its Income

Question

I have an offer to buy a pharmacy and it dispense medication to patients to be delivered at home. the point is to keep these patients they ask for money the current owner is paying them 10% of what he earnsis it Haram if I will follow his way

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

If you mean that a medical institution –whether a hospital and the like –conditions on the pharmacist to pay a percentage of his income in return for referring the sick to his pharmacy: then such a dealing (transaction) is forbidden because it is consuming people’s money unjustly, and because it leads to malpractices and violations of the ethics of the medical profession and the rules of work therein.

The Council of Islamic Jurisprudence, Research and Islamic Studies in Jordan said that this treatment is not permissible and is not suitable for the medical profession which aims to serve the human being, for the following considerations:

Firstly, because it is a delusion to the patient that this Center is the best, which is forbidden, because Allah Says (what means): {O you who have believed, fear Allah and be with those who are true.} [Quran 9:119]

Secondly, it is consuming people’s money unjustly, because the doctor takes money in return for nothing.

Thirdly, it corrupts the obligation of the doctor and transforms him from being a doctor who cares for and relieves the suffering of the patient, to a materialistic person motivated by greed to trade with the sick and increase their pain and suffering.

Fourthly, this violates the ethics of the medical profession.” [End of quote]
