Using a CPAP Machine During Ihram for Men

Question

Assalamoalaikum, I have a medical condition called obstructive sleep apnea, in this condition my breathing is obstructed constantly while sleeping and I need to use a CPAP machine with a face mask/nose mask to breath properly during sleep every night. InshAllah in the state of Ihram during Hajj process can I use these masks? Is there a fidiya or penalty that should I give when I use these masks every night to sleep during Hajj?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad (ﷺ) is His Slave and Messenger.

There is no harm for a man in the state of ihram to cover his face, according to the stronger opinion of the scholars, especially when there is a need for doing so.

Ibn Qudamah ( may  Allaah  have  mercy  upon  him) said in Al-Mughni:

Regarding a person in ihram covering his face, there are two narrations. One of them is that it is permissible. This was reported from ʿUthman ibn ʿAffan, ʿAbd al-Rahman ibn ʿAwf, Zayd ibn Thabit, Ibn al-Zubayr, Saʿd ibn Abi Waqqas, Jabir, Al-Qasim, Tawus, Al-Thawri, and Al-Shafiʿi.

The second narration is that it is not permissible, and this is the view of Abu Hanifah and Malik...

Our evidence is what we mentioned from the statements of the Companions, and we do not know of any disagreement among them during their time, so this constitutes consensus.” [End quote.]

Accordingly, there is no harm upon you in using this mask over the face or nose while in the state of ihram for Hajj or ʿUmrah, and no expiation or other penalty is required from you.
