Question
Is nikah on the telephone permitted in Shariah?
Answer
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad 
is His slave and Messenger.
The Islamic Fiqh Committe determined in its sixth session in the month of Sha'ban 1410 A.H that it is not permissible or acceptable to conduct a marriage contract through the phone because it is a condition to have witnesses over it and this cannot be done in an accurate manner through the phone.
