Question
What is the situation if my husband says to me "You are divorced" on the telephone. He divorces me on the telephone. And how long is the waiting period for a pregnant woman. Can my husband divorce me when I am pregnant?
Answer
Praise be to Allah, the Lord of the Worlds; and may His blessings and peace be upon our Prophet Muhammad and upon all his Family and Companions.
Whoever says to his wife: 'you are divorced' then she is divorced. There is no difference between saying it over the phone or directly face to face. The waiting period for the pregnant woman is until she gives birth to her child. Allah Says (interpretation of meaning): {And for those who are pregnant (whether they are divorced or their husbands are dead), their 'Iddah (prescribed period) is until they deliver (their burdens),…..}[65:4].
Divorcing a pregnant woman is permissible and it is not considered as an innovated Talaq (Talaq Bida').
