Division of separate inherited pieces of land among the heirs

Question

If my sister wants to sell the land that she proportionately got from our father`s property after his death. As she will get from every part of the land, it will be so small that no body beside me would like to buy these pieces of land with good price. On this excuse, I may buy her part with a nominal price. But if we reach to the agreement that we will not divide the lands rather she will take her part from one area and I will take another area, then she will get a bigger land which will be sold with good price. Is it halal for me to buy her part with a nominal price on the excuse mentioned above?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

That land is to be divided either according to the consent of all the heirs to a given form of division, or by drawing lots, or by the heirs taking turns in benefiting from the land according to their share in the inheritance. Or the land may be sold and its price divided.

In any case, if there is consent among the heirs to divide the land in a given manner, it is permissible for you to buy from your sister her share in the land, after this land is determined and after you both agree on a given price.
