Wants to Marry Again after Unsuccessful Marriage

Question

Are there any pre-conditions for the second marriage? I am unhappy with my marriage and plan to get separated shortly. We didn't really get going even a year after marriage.

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

Allah the Exalted made lawful for a Muslim to marry more than one wife, up to four wives at a time, if he is able or believes that he can be just among them. To marry a second wife, it is not necessary to divorce the first one, but sometimes a second marriage encourages steadfastness by the first wife. Know that in Islam people are urged to marry; likewise, they are warned of Talaq (divorce). Divorce is permitted only as a last solution. The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said: “O young people! Whoever can marry should marry, as it helps to lower one’s gaze, and protects one’s private parts, and whoever is not able to marry should fast, as this helps him to protect his private parts (from committing illegal sexual intercourse).” [Al-Bukhari and Muslim]

Allah Says (what means): {And if you fear dissension between the two, send an arbitrator from his people and an arbitrator from her people. If they both desire reconciliation, Allah will cause it between them. Indeed, Allah is ever Knowing and Acquainted [with all things].} [Quran 4:35]

Therefore, we advise you, dear brother, to continue with your wife as long as there is no harm for both of you. We also advise the wife to spare no effort to be a good wife and to behave in such manner that pleases her husband.
