Issues about inheritance

Question

I would like clarification on inheritance, how and when it is to be divided? If one parent dies and there are children is it divided then or is it done after the second parent dies? May they live as long as Allah permits them.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

The wealth of a dead person is immediately transferred to his heirs after his death.

The wife of a dead person is one of the heirs. The heirs should not wait until the wife (of the dead person) dies as well.

However, the inheritance should not be distributed among the heirs before paying the debts of the dead person or any other due.

Besides, the will of the dead person should also be fulfilled on the condition that it does not exceed the third of the wealth.

All the normal expenses of the funeral should be taken from the inheritance as well as any other expenses related to the inheritance itself.
