Inheritance of three sons and five daughters

Question

What is part of daughter in the wealth (property) of mother after the death of her mother? Having three brothers and four sisters all married.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

This daughter who has brothers and sisters will inherit with them after the shares of heirs mentioned in the Qur'aan, if any, had been distributed; the male has twice the share of that of a female. But if there is no heir, then she will inherit from the totality of the inheritance; the male having two portions of that of a female. Allaah says (interpretation of meaning): {Allah instructs you concerning your children [i.e. their portions of inheritance]: for the male, what is equal to the share of two females.}[4:11]. We finally draw your attention that matters of inheritance have to be referred to Islaamic courts, as there are always disputes about this matter, and the Islaamic court is more appropriate to look to all the subjects relating to this matter.

Allaah knows best.
