Question

Sir my question is about the Qazaa Prayers sir recently i read a newspaper in which a Ulma said abt the timings of prayers in which he said a person can offer isha prayer even before the time of Fajr prayer starts means 3 mins before similar that all prayers like Magrib prayers we can offer magrib prayers before the azaan of Isha he said it is better to offer as early as possible is that true or these prayers will be count in Qazaa

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

What you mentioned, that it is permissible to delay the time of 'Ishaa' prayer until before the time of the Fajr prayer is something which some of the jurists may Allaah have mercy upon them did actually mention, as the scholars differed in opinion about the ending time of 'Ishaa' prayer. The view we adopt here in Islamweb is that the time of ‘Ishaa’ which one has the choice to pray during any part of it extends to the middle of the night, and after that starts the period of necessity which extends until the time of Fajr prayer; as the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) said: The time of 'Ishaa' prayer extends to the middle of the night.[Muslim]. Therefore, it is not permissible to delay the 'Ishaa' prayer until after the middle of the night without a necessity or a valid reason. For more benefit, please refer to Fataawa 88333 and 81480.

Similarly, according to the most correct opinion, it is not permissible to delay the 'Asr prayer until the time of necessity, because the 'Asr prayer has two times which we clarified in Fatwa 84538.

As regards the Maghrib prayer, its time ends with the disappearance of the twilight and the beginning of the 'Ishaa' prayer, according to the correct opinion of the jurists may Allaah have mercy upon them. Therefore, whoever performs the 'Ishaa' prayer before its time ends even by few minutes has performed it on time. There is no doubt that performing the prayer early after making sure that its time began is something religiously required (unless it is Thuhr prayer on a very hot day,) because performing the prayer early is a form of rushing to perform good deeds and act of obedience at an earlier time. The companions may Allaah be pleased with them used to perform the Maghrib prayer and go back home while they were able to see the place where they had thrown their arrows (i.e. there was still enough light to see things).

For more benefit, please refer to Fatwa 81532.

Allaah Knows best.
