Question
What is the Islamic ruling of the one who practices unlawful sexual intercourse knowing that he is a divorcee and does not find financial means to re-marry?
Answer
All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.
Allaah Almighty says (what means): {And they who guard their private parts, except from their wives or those their right hands possess, for indeed, they will not be blamed—but whoever seeks beyond that, then those are the transgressors} [Quran 23: 5-7]
The noble verse stated that all sexual practices are forbidden except through these two ways: one's wife and his slave girl. It is known that slavery no longer exists all over the world. Thus, nothing lawful remains except either marriage or restraining desires by means of fasting. This is because the Prophet, sallallaahu ‘alayhi wa sallam, said: “Whoever cannot afford it (i.e. marriage), let him fast, for it is a shield for him," meaning a protection from immorality. Dear brother, do many acts of worship, especially fasting. Whoever wants to be saved from the punishment of Allaah Almighty, let him beware of the different types of fornication. That is because fornication entails the torment of Hellfire in the Hereafter if one does not repent of it. May Allaah guard us against it. Allaah Almighty says (what means): {And those who do not invoke with Allaah another deity or kill the soul which Allaah has forbidden [to be killed], except by right, and do not commit unlawful sexual intercourse. And whoever should do that will meet a penalty.} [Quran 25: 68-69]
There is no way out of that huge sin except through repentance and turning back to Allaah Almighty. Allaah Almighty has joined the mention of unlawful sexual intercourse with that of intentional killing, as we see in the aforementioned verse. We ask Allaah Almighty to guard us against all sins.
