AsSlaamWalekum....Fatwa is issued on Lyoness company, stating that this is haram to work for this company because it is not allowed to buy discount cards; because u don't know what u will u get in return. Whereas this company clearly tells u that u will get certain amount of % on your shopping and u will also get units for the amount u will pay as an investment. (Units as in share).And also their is no hierarchy in this company because you can earn more than a person who is joined this company 5 years before you.if u are more active u can reach top level regard less of when u joined this company. Please throw some lights on this points.JajazkAllah.
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad 
is His slave and Messenger.
What you have mentioned about the company clearly stating that the client will receive a certain percentage from the value of the purchases "in the form of refunds to his bank account" as well as receiving a specified number of points on the amount paid as investment "units as in share", this does not eliminate the risk involved; rather, one pays money in return for a potential and unknown matter. One may receive high profits if he buys too much, and if one does not buy, he loses the subscription fees and all monies paid.
So what you have mentioned does not affect our answer in Fatwa 137046.
Also, the issue of whether a new member may earn more money than another member who participated five years ago based on activeness and diligence, then a network marketing system which is forbidden in Islam does not become permissible because of this. This is concerning whether the partner provides funds or buys commodities which he generally has no purpose for in return for profits and gains expected from marketing and from attracting new members.
